Online Contest Official Rules

1. INTRODUCTION: Source Interlink Magazines, LLC (“Sponsor”) is offering the following contest as described in these official rules: “PMY's Win That Yak” ("Contest").

2. ELIGIBILITY: The Contest is open only to legal residents of the 50 United States and the District of Columbia who as of October 15, 2008 are 18 years of age or older. Employees of the Sponsor and their respective parents, subsidiaries, affiliated companies, dealers and agents, and the foregoing employees’ household or immediate family members (defined as parent, spouse, child, sibling or grandparent) are NOT eligible to enter the Contest.

3. TIMING: Contest begins at 12 A.M. Eastern Time ("ET") on October 15, 2008 and ends at 11:59 P.M. ET on November 15, 2008 ("Contest Period").

4. HOW TO ENTER: To enter: Go to www.powerandmotoryacht.com/contests. Once there, use the e-mail link to tell us in 100 words or less (no less than 40) how you would use your Walker Bay Airis Sport 10 Kayak. Put Kayak Contest in the subject line. Any entry that contains lewd material or that may be deemed offensive to Sponsor or third parties may be disqualified by Sponsor in their sole discretion. See additional entry restrictions in section 5. Sponsor reserves the right to include a Contest official entry form at any additional authorized website or other authorized location.

5. SUBMITTED ESSAY: By participating in the Contest, entrant warrants and represents that: (a) the submitted essay is unpublished, original, does not violate any law or regulation and does not infringe or violate any third party rights, including but not limited to the rights of copyright, trademark, privacy and publicity; and (b) submitted essay does not contain sexually explicit content or violent or offensive material.

6. PRIZE: Winner will receive a Walker Bay Airis Sport 10 KayakThe total approximate retail value of the prize is $1,149.00 No cash or other substitution may be made, except by Sponsor in the event that a prize or part thereof cannot be awarded for any reason; in such event, Sponsor will in their sole discretion award a substitute prize or part thereof of equal or greater value. Contest prize is nontransferable, must be accepted as awarded and subject to the conditions herein will be awarded. Winner is solely responsible for the following in relation to a Contest prize awarded to him/her: Visual prize depictions may not accurately represent an awarded prize. Winner responsible for all federal, state and local tax.

7. JUDGING: on or about November 25, 2008, all eligible entries received will be judged by the PMY staff (the Contest winner) based on the following criteria: creativity, originality, and humor, in equal measure. The decisions of the Sponsor and/or Contest judge(s) on all matters related to the Contest shall be final and binding in all respects. A participant selected as a potential Contest winner must comply with all the terms and conditions set forth in these official rules, and winning is contingent upon fulfilling all such requirements.8. NOTIFICATION: On or about December 1, 2008 the potential Contest winner will be notified (the "Notification") by e-mail, mail or courier (or other method at the discretion of Sponsors). Within ten (10) days of the actual send date, postmark or shipment date of the Notification, a potential winner may have to correctly complete, execute and return the following document as directed: An Affidavit, Waiver, Release and Indemnity Agreement, including where lawful a Publicity Release. Please note that an additional document(s) may be required at the discretion of Sponsor. Failure to comply with the requirements of this paragraph (or the return of any prize or prize notification as non-deliverable) may result in disqualification and in the forfeiture of any right to a Contest prize, an alternate entrant will be selected in his or her place from all remaining entries received in accordance with the herein described judging criteria.

9. E-MAIL ADDRESS: In the event of a dispute regarding which individual submitted any entry, such entry will be deemed submitted by the natural person whose name is on the Contest entry form.

10. RELEASE: By participating in the Contest and/or accepting a prize, a participant/winner agrees to defend, release and hold harmless the Sponsor and their respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, members, managers, employees, representatives, agents and all others associated with the development and execution of the Contest (collectively the "Releasees") from and against any actions, claims and/or liability for injury, loss or damage of any kind (including any for the violation or infringement of any proprietary or personal right of any individual or entity, and any personal injury, death and/or property damage) resulting in whole or in part, directly or indirectly, from participation in the Contest, and/or the use, acceptance, or possession of a Contest prize, and/or participation in a Contest prize-related activity. By participating in the Contest and/or accepting a prize, a participant/winner consents to and gives the Sponsor and their respective representatives, licensees, assignees, parents, subsidiaries, affiliates, divisions, advertising and promotion agencies (collectively the “Licensees”): a) The right to photograph/video a winner and a winner’s property (including an awarded Contest prize); and b) The right in perpetuity to use, reuse, publish and display a participant’s/winner’s name, address, entry form information, statements, quotes, opinions, picture, portrait, likeness, voice, video, photograph(s), biographical information, prize information, and winner-submitted photograph(s)/essay/video/text/blog(s) (in whole or in part, as may be adapted, edited or modified, as solely determined by Licensees) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without limitation or additional consideration, unless prohibited by law. Materials submitted in Contest become the sole property of Sponsor and will not be acknowledged or returned.

11. CONDITIONS: Participants agree that by participating in the Contest they release the Releasees from any liability in connection with: a) Entries that are ineligible as a result of being lost, late, illegible, damaged, incomplete, stolen, or misdirected; b) Any typographical or other human or technical errors in the offer or administration of the Contest, including but not limited to errors in advertising, these official rules, the selection and announcement of a winner(s), or the distribution/awarding of a Contest prize(s); and c) Any omission, interruption, deletion, defect, delay, misdirection, damage, line failure, injury, technical malfunctions or traffic congestion on the Internet/telephone network, or at any website, or any combination thereof. Sponsors reserve the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest. In the event that the Contest is infected by a computer virus/worm, or is not capable of running or being executed as planned (as a result of but not limited to an error, omission, defect, delay, misdirection, tampering, unauthorized intervention, fraud, action of entrants, or technical failure) or any other cause which in the sole opinion of Sponsors corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsors reserve the right in their sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Contest (collectively a “Contest Revision”). In the event of a Contest Revision, notice thereof will be posted at the Contest website, including information (where applicable as determined solely by Sponsors) regarding winner determination from among all eligible non-suspect and/or non-disqualified entries. Releasees shall have no liability to any participant/winner who is disqualified due to a Contest Revision. Failure to enforce any term of these official rules shall not constitute a waiver of that provision.

12. LAWS: Subject to all federal, state and local laws and regulations. Void where prohibited or restricted.
